Terms of Service
Effective date: August 6, 2026
These Terms of Service govern access to and use of AuntBird. By creating an account, purchasing a subscription, or using AuntBird, you agree to these terms on behalf of yourself and the organization you represent. If you do not agree, do not use the service.
1. The service
AuntBird provides cloud-based practice-management tools that may include client and contact management, engagements, time and expense tracking, billing, invoicing, payment records, reporting, employee tools, communications, and related administrative features. Features may be changed, improved, added, or removed.
2. Accounts and authorized users
You must provide accurate account information, protect login credentials, and promptly notify AuntBird of suspected unauthorized access. Your organization is responsible for its users, their permissions, and all activity occurring through its accounts, except to the extent caused directly by AuntBird's breach of these terms.
3. Customer data and responsibilities
Your organization retains responsibility for information it enters into AuntBird. You represent that you have the rights, permissions, and lawful basis needed to collect, use, and provide that information. You are responsible for configuring user access appropriately and for reviewing the accuracy of invoices, reports, calculations, records, and communications before relying on or sending them.
AuntBird is practice-management software. It does not provide legal, accounting, tax, payroll, investment, or other professional advice and does not replace your organization's professional judgment or compliance duties.
4. Acceptable use
You may not use AuntBird to:
- Violate law, regulation, contract, privacy rights, or intellectual-property rights.
- Access another customer's data or account without authorization.
- Upload malicious code, interfere with service operation, probe security controls, or attempt unauthorized access.
- Use the service to send unlawful, deceptive, abusive, or unsolicited communications.
- Resell, reverse engineer, copy, or exploit the service except as expressly permitted in writing.
5. Subscription, billing, and taxes
Paid subscriptions renew on the billing cycle shown at checkout until canceled. You authorize the applicable recurring charges and agree to keep payment information current. Prices may change with advance notice. Fees are generally nonrefundable except where required by law or expressly stated otherwise. Your organization is responsible for applicable taxes, excluding taxes based on AuntBird's net income.
6. Third-party services
AuntBird may interact with third-party services such as Stripe, email-delivery providers, hosting providers, and other integrations. Third-party services are governed by their own terms and policies. AuntBird is not responsible for third-party services outside its reasonable control.
7. Availability, maintenance, and changes
We work to keep AuntBird available and reliable, but uninterrupted or error-free operation is not guaranteed. Maintenance, updates, Internet failures, provider outages, security incidents, and other events may temporarily affect availability. We may suspend access when reasonably necessary to protect the service, customers, or others.
8. Intellectual property
AuntBird and its software, design, branding, documentation, and related materials are owned by AuntBird or its licensors. Subject to these terms and payment of applicable fees, your organization receives a limited, nonexclusive, nontransferable right to use the service for its internal business operations during the subscription.
9. Confidentiality
Each party may receive nonpublic information from the other. Each party will use reasonable care to protect confidential information and will use it only for the relationship contemplated by these terms, except where disclosure is authorized or legally required.
10. Termination
You may cancel according to the account and billing options made available to you. AuntBird may suspend or terminate access for nonpayment, material breach, security risk, unlawful use, or discontinuation of the service. Upon termination, access may end and customer data may be deleted following applicable retention practices. Export important records before termination whenever possible.
11. Disclaimers
To the maximum extent permitted by law, AuntBird is provided on an "as is" and "as available" basis. AuntBird disclaims implied warranties, including merchantability, fitness for a particular purpose, noninfringement, and warranties arising from course of dealing or usage of trade. Some jurisdictions do not permit certain disclaimers, so portions of this section may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, AuntBird will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business, goodwill, or data. AuntBird's aggregate liability arising from the service will not exceed the fees paid for the service during the twelve months before the event giving rise to the claim. These limitations apply regardless of the legal theory and even if a remedy fails of its essential purpose.
13. Indemnification
Your organization will defend and indemnify AuntBird against third-party claims arising from customer data, your organization's unlawful or unauthorized use of the service, or your organization's violation of these terms, except to the extent caused by AuntBird's own unlawful conduct.
14. General terms
These terms and the Privacy Policy form the agreement concerning use of AuntBird unless a separate signed agreement applies. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these terms without written consent; AuntBird may assign them in connection with a merger, reorganization, sale, or transfer of the service or business.
